SmartScroll Terms of Service

These terms are an agreement between you and SmartScroll LLC ("SmartScroll", "we", "us"). By creating an account or using SmartScroll, you agree to them.
1. Who can use SmartScroll
Accounts are created and managed by a parent or legal guardian who is at least 18. Students do not have accounts, email addresses, or passwords with us; a student uses SmartScroll on a device that a parent may link to the parent's own account. If you link a student, you confirm you are that student's parent or legal guardian, you consent to the data practices in our Privacy Policy, and you accept these terms on the student's behalf and are responsible for their use.
2. The service
SmartScroll is a learning feed for students, with short lessons and practice, an AI tutor, a homework photo solver, teach-back exercises, progress tracking, and a parent dashboard. Features and content may change as we improve the product. New users can try the full experience once as a free demo (Section 3); continued use requires a paid plan.
3. The demo and paid plans
New users can try the full experience once, free: a sample of the learning feed, the homework solver, the AI tutor, and one complete tutoring session, with no account and no card. After the demo, continued use requires one of the three optional paid plans described in Sections 4 to 6. You are never charged unless you choose a paid plan and complete checkout.
4. Plans, trials, and cancellation
- Three plans (prices in USD). SmartScroll offers three optional plans (new users start with the one-time demo in Section 3):
- Good ($19.95/month): the app, the six-subject learning feed with higher daily AI-tutor and photo-solver limits, plus the parent dashboard with cross-device sync. One student.
- Better, the AI Tutoring Program ($49.95/month or $449/year): everything in Good, plus structured, scheduled tutoring sessions with a parent-visible report for each, an AI-built learning pathway, and progress analytics. One student.
- Best, the Full Program ($99.95/month or $899/year): everything in Better, plus unlimited tutoring sessions and up to 3 students on one account.
- 14-day free trial. Each plan starts with a 14-day free trial. A payment method is collected at checkout; the trial converts to a paid subscription at the end of the 14 days unless you cancel first, and if you cancel during the trial you pay nothing. Your family page shows the exact conversion date while you are trialing.
- Auto-renewal. Subscriptions renew automatically each billing period until you cancel.
- Cancel or change any time. The "Manage billing" button on your family page opens the Stripe billing portal, where you can cancel, switch plans (Good, Better, or Best) or billing periods (monthly or yearly, where offered), and update your payment method. Cancellation takes effect at the end of the period you already paid for, and you keep premium access until then.
- What cancellation never does. Canceling never deletes or locks anything. Your student's progress, the core learning feed, and the parent dashboard remain available on the free floor (premium AI limits return to the free daily caps); a family that has subscribed is never sent back to the one-time demo. Data deletion only happens when you delete it or under the inactivity policy in our Privacy Policy.
5. Failed payments
If a renewal payment fails, nothing is locked immediately: premium features continue for a 7-day grace period after the end of the paid period while you fix the payment method (we email you, and your family page shows a banner with the days remaining). If payment still fails after the grace period, the account settles onto the free floor: premium AI limits pause (returning to the free daily caps), and everything else (all progress, the core learning feed, and the parent dashboard) keeps working. A family that has subscribed is never sent back to the one-time demo. Fixing the payment restores premium.
6. Refunds
Except where the law requires otherwise, payments are not refundable and we do not give partial refunds for unused time in a billing period; when you cancel, you keep access until the end of the period instead.
7. The AI tutor can be wrong
The AI tutor, photo solver, and teach-back feedback are generated by an AI model. AI answers can be incorrect, incomplete, or outdated, even when they sound confident. SmartScroll is a study aid: it supplements a student's school, teachers, and curriculum, and is not a substitute for any of them. Students should verify important answers with their teacher or textbook. Nothing in SmartScroll is medical, psychological, legal, or financial advice; personal-finance lessons are education only.
8. No promise of grades or outcomes
We do not promise or guarantee any specific academic result: no particular grade, test score, admission, or improvement. Learning outcomes depend on the student and how the product is used. Any progress metrics we show (XP, streaks, mastery) describe activity inside SmartScroll, not school performance.
9. Acceptable use
Do not: use SmartScroll to break the law or harm anyone; probe, overload, or interfere with the service or its rate limits; attempt to access another family's data; scrape, resell, or commercially exploit the service or its content; reverse engineer the service except where the law grants that right; misrepresent yourself as a student's parent or guardian; or use the AI features to generate content unrelated to learning. We apply technical limits (rate limits and daily caps) to keep the service safe and affordable; circumventing them is a violation of these terms.
10. Your content and ours
SmartScroll's lessons, software, and branding belong to SmartScroll LLC or its licensors; you get a personal, non-transferable, non-exclusive license to use them for your family's learning while these terms apply. Anything a student types or photographs remains yours; you give us the limited right to process it to provide the service (for example, sending a homework photo to our AI provider to generate the explanation), as described in the Privacy Policy.
11. Termination
You can stop using SmartScroll and delete your account at any time from the family page; deletion is immediate and permanent. We may suspend or terminate accounts that violate these terms, abuse the service, or create risk for us or other users, and we may discontinue the service with reasonable notice. If we terminate without cause while you have paid time remaining, we will refund the unused portion.
12. Disclaimers and limits on liability
SmartScroll is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the extent the law allows. To the extent the law allows, SmartScroll LLC's total liability for all claims relating to the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages. Some jurisdictions do not allow certain warranty disclaimers or liability limits, so parts of this section may not apply to you.
13. Governing law and disputes
These terms are governed by the laws of the state in which SmartScroll LLC is organized, excluding its conflict-of-law rules, and disputes will be resolved in the courts located there, except where consumer-protection law gives you the right to your local courts and law.
14. Changes to these terms
We may update these terms. If a change is material, we will notify parents by email or an in-product notice before it takes effect; continuing to use SmartScroll after the effective date means you accept the updated terms. If you do not accept, stop using the service and, if applicable, cancel your subscription.
